These API Terms govern access to the Tended agent tools API (the "API") operated by Organic Gardening Collective / Flow Solutions Group ("we", "us"). By requesting or using an API key, you agree to these Terms on behalf of yourself and any organization you represent. They supplement our Terms of Use and Privacy Policy.

1. Acceptable use

You will not use the API to: (a) exceed your plan's rate or credit limits or circumvent metering; (b) resell, sublicense, or redistribute raw API responses except as permitted by the Attribution License below; (c) build a competing gardening-content corpus by bulk extraction; (d) submit unlawful content or images containing other people's personal or biometric data without authority; or (e) use outputs to make medical, food-safety, foraging, or plant-edibility decisions (see Disclaimer).

2. Attribution license

Curated answers are licensed to you only on the condition that, wherever you surface an answer to an end user, you display "Organic Gardening Collective" and a clickable link to the answer's source_url. This license terminates automatically if you remove or suppress attribution.

3. Our analytics rights

You grant us a perpetual, royalty-free right to log and process metadata and content of your requests to operate, secure, meter, and improve the Service and to compute aggregated, de-identified statistics (which we may license per our Privacy Policy). We will not publish your raw requests or anything identifying you or your end users.

4. Warranty disclaimer

THE API AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. GARDENING ANSWERS, PHOTO CHECK-UPS, AND OTHER OUTPUTS MAY BE WRONG AND ARE NOT PROFESSIONAL, MEDICAL, OR FOOD-SAFETY ADVICE.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE API WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE PRIOR 3 MONTHS OR USD $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING ANY PLANT, HEALTH, VEHICLE, SAFETY, OR CROP OUTCOME. Nothing here limits rights that cannot be limited under applicable law.

6. Payments are final

All fees, prepaid credits, and Lightning payments are non-refundable and final once a request is served. Tool calls are delivered instantly on payment, so you agree not to initiate a chargeback, reversal, or dispute for delivered calls, to the maximum extent permitted by law. Prepaid credits do not expire but are not redeemable for cash. Lightning/Bitcoin settlements are irreversible by nature.

7. Indemnity

You will indemnify us against claims arising from your use of the API or outputs, your end users, or content or images you submit, including claims that submitted images infringed rights or contained personal data you had no right to send.

8. Disclaimer pass-through

Every API response includes a disclaimer field. Whenever you surface plant-identification, edibility, safety, or health-related output to an end user, you must pass that disclaimer through to them.

9. Data processing

Where you act as a controller or business and we process personal data on your behalf through the API, our Data Processing Addendum (available on request) applies. Our current sub-processors include Anthropic (AI model) and Supabase (hosting/database); we will give at least 30 days' notice of new sub-processors.

10. Changes & governing law

We may update these Terms; material changes will be posted here with a new date. These Terms are governed by the laws of the State of Florida, USA, without limiting non-waivable consumer rights under your local law.
